Our fees

Every estate agent in France must publish a fee schedule showing its maximum fees including VAT and who pays them. Ours is below, followed by an explanation of how agency fees work.

Fee schedule

The fees below are maximum fees, stated including all taxes.

Sale of a house or villa

To be completed: sale fee for houses and villas as a percentage of the sale price including VAT; any price bands with a statement of whether they are cumulative; any minimum fee

To be completed: who pays the sale fee: the seller or the buyer

Sale of an apartment

To be completed: sale fee for apartments as a percentage of the sale price including VAT; or confirmation that the house and villa scale applies

Search mandate

To be completed: search mandate fee (a percentage of the purchase price including VAT or a fixed amount) and confirmation that the buyer pays it

Valuation

To be completed: whether a written avis de valeur is free or charged; if charged, the amount including VAT

VAT

To be completed: whether the fees include VAT at 20% or whether VAT is not applicable to Amber Connections, with the wording that applies

What the rules require

The barème des honoraires is governed by the arrêté of 10 January 2017 on information for consumers from professionals involved in a property transaction, as amended on 26 January 2022. The DGCCRF, which enforces these rules, publishes guidance on them. In summary:

  1. The schedule must be displayed where clients are received and published on the agent's website.
  2. Fees are stated including all taxes (TTC).
  3. For a sale, the schedule must say whether the fee is paid by the seller or by the buyer.
  4. The figures are maximum prices. The fee actually charged may be lower after negotiation, but never higher than the schedule.
  5. Where a percentage varies by price band, the schedule must say clearly whether the bands are cumulative.
  6. In an advertisement where the buyer pays the fee, the price must be shown both including and excluding fees, with the fee as a percentage of the price excluding fees. Where the seller pays, the advertisement shows the price alone.

When fees are paid

Under the Loi Hoguet of 2 January 1970 no agent may act without a written mandate, which must state the fee and who pays it. No fee may be demanded or accepted before the transaction has actually been concluded and recorded in a signed deed. In practice the fee is paid at the signature of the acte authentique.
